Terms

Once the deposit is received, the buyer will secure an available draft pick spot chosen for their selected breeding and gender or the buyer will secure the chosen puppy if the draft has already passed. The pick number will be indicated on the first page of this contract. Each gender will have a separate draft pick. If the deposit was received prior to birth, the buyer can be refunded the deposit amount when there are not enough puppies born to cover the buyer's selected draft pick number. Under normal circumstances, deposits are not refundable on existing puppy reservations. Alternatively, deposits can also be moved to another litter.

If we don't have an agreement in place and your puppy is not picked up within 3 days after the designated go home date, there will be a daily charge added to your total cost. The daily fee will be set at $15 a day. We will waive the fee if transportation has been scheduled and circumstances caused a delay to the transport entity. It's best to pick up your puppy as soon as you can so you can start the socialization and training process at this important stage in development.

Buyer understands that a Boerboel was bred for protection and is a dominant breed. Buyer agrees to socialize and train the dog based on the temperament wanted out of the dog. Buyer understands that PeterBuilt Boerboel cannot be held responsible for temperament and behavioral problems. We have a strong focus on breeding a desirable temperament, but it cannot be guaranteed on our end as temperament can also be critically affected by the amount of socialization and training incorporated during the puppy's development. More information about training your Boerboel for the type of dog you want will be located on our website and can be found elsewhere.

If buyer breeds the boerboel without purchasing breeding rights, civil penalties will be pursued through civil proceedings. Buyer will be responsible for court costs. If an accidental breeding occurs, let us know and we can work through the issue together.

Peterbuilt Boerboels is not responsible for medical expenses or regular day to day costs relating to the care of your Boerboel.

Buyer agrees they have done research on the Boerboel size, temperament, and understands the health and care issues related to owning and caring for a Boerboel which include but are not limited to hip dysplasia, elbow dysplasia, joint diseases, skin problems, heart conditions, eye conditions, knuckling, digestive conditions, and any other diseases or tendencies that could be associated with the Boerboel breed.

Buyer agrees that Peterbuilt Boerboels will not be held responsible for any type of medical treatment for the above listed puppy/dog at any time.

Buyer understands Peterbuilt Boerboels will not be held responsible for injury or death caused by owner mismanagement, to include: over-exercise, overfeeding, overheating, abuse, neglect, accidents, or bloat/gastric dilation/volvulu. The buyer agrees to seek veterinarian care upon discovery of any serious condition. If you suspect death has occurred through a condition covered in our health guarantee, a necropsy report will be required to be covered by the guarantee.

Buyer understands a boerboel puppy should have their playtime monitored closely. It is recommended to limit hard slippery surfaces, extensive jumping, or any activity that can cause undue stress to underdeveloped joints. This can lead to poor elbow/hip development and can cause a lifetime of discomfort for your Boerboel. Expose at your own risk.

Buyer acknowledges that most Boerboels do the following and will have to take steps to prevent these issues and/or accept these issues:

  • Drool to some degree.
  • Tend to be home/yard/family protective (what they were originally bred for).
  • Step on your toes.
  • Shed.
  • Require much more food than other breeds.
  • Do not thrive and can be destructive if left alone often.

The buyer agrees to notify the seller FIRST if they no longer want their Boerboel dog/puppy. Buyer agrees to give seller first rights to the dog before allowing the dog to leave the buyer's possession. Buyer must receive written consent from Peterbuilt Boerboels before any Peterbuilt Boerboel is rehomed to a third party.

If the boerboel is rehomed without written consent, all ownership rights will be forfeited and not transferred, Peterbuilt Boerboels will become the sole owner of the boerboel. Peterbuilt Boerboels will assist a buyer with finding placement if the dog is not working out for their lifestyle. If placement is not found, then the dog will go back to Peterbuilt Boerboels until a suitable home is found. All transportation and shipping costs will be the buyer's responsibility.

UNDER NO CIRCUMSTANCES SHOULD ONE OF OUR BOERBOELS BE TAKEN TO A SHELTER.

There is no judgment from us if you are having an issue of any kind or if a Boerboel just doesn't fit your lifestyle. We'll accept the Boerboel back before we allow anyone to bring him/her to a dog shelter of any kind.

Again, do not ever be ashamed to reach back out to us if this dog is not working out for you. We want what is best for our dogs.

BUYER AGREES TO PAY SELLER THE SUM OF $10,000, payable immediately and pursuable in court at buyers' expense if one of our dogs are FOUND IN A SHELTER OR FOUND TO BE MISTREATED in a manner that violates your local animal cruelty laws.

Important:

Most importantly, this Boerboel puppy/dog will NOT be left to live in a crate or kennel only. This puppy was sold as a family pet first and we screened for specific applicants like you because we believed you would treat them like family as we do. Please do your part and treat these special dogs like the magnificent creatures they are. With structure, love, and proper guidance they will develop into wonderful specimens that will uphold the breed standards and be your most loyal companion/protector.

Crate training and reasonable amounts of time in a crate/kennel are understandable and useful, please don't make that their full-time home. All our dogs here have a minimum of 70 sq ft of indoor heated/airconditioned space and constant access to a decent sized outdoor yard; if we can do that with a double-digit number of dogs, then you should be able to do better. Besides, a boerboel can be your first line of defense in the event of a home invasion, I encourage you to not take that ability away from him/her and let them have some freedom to roam.

Waitlist Queue Policy

In the event that a litter does not produce enough puppies to fulfill all reserved picks, buyers whose picks cannot be fulfilled will be placed in a waitlist queue. Queue position is determined by deposit received date, with earliest deposits having highest priority.

When a new litter becomes available, queue buyers are notified sequentially in priority order. The first buyer in the queue will receive an email with exclusive 24-hour access to reserve a pick from the new litter. If no selection is made within 24 hours, access passes to the next buyer in the queue, who also receives 24 hours to make a selection. This process continues until all queue buyers have had the opportunity to select.

If a buyer chooses not to select from a new litter, no action is required - they will remain in the queue for future litters. When placed in the queue, the original contract becomes void. The deposit may be applied to a new reservation or refunded upon request.

Breeding Restrictions (for those purchasing breeding rights)

If breeding rights are granted, breeding rights are NOT transferrable unless approved by Peterbuilt Boerboels. As stated above, notify us first if you decide to re-home your boerboel.

If a third-party person, not named in this contract, is found in possession of a Peterbuilt boerboel and uses the boerboel as breeding stock in their program without our written consent, we will pursue civil proceedings to reclaim the boerboel. We will also pursue the named buyer on this contract and the third-party buyer in civil court to cover all financial damages.

A female breeding dog is not to be bred prior to 16 months of age, time must be allowed for the bitch to develop and for you to identify any health problems prior to breeding.

Breeding dogs must have health testing done prior to being bred. At minimum, the testing must meet OFA or equivalent standards for an acceptable breeding dog in the areas of hips, elbows, and heart.

Breeding dogs must also be fully registered and meet registry breeding standards prior to being used.

Health Guarantee

The puppy is guaranteed to be in good health per seller. For the Health Guarantee to be valid, you must take your puppy to a certified veterinarian within 3 business days of the puppy's arrival at your home.

If the puppy is found not to be in good health within the 3-business day period and has an irreparable problem, please do the following:

  • Contact us immediately
  • Send over vet paperwork the same day as the appointment
  • Puppy must be returned to seller ASAP at buyers' expense

You will have the option to be added to first available litter of equal value or a full refund at the cost of the puppy excluding shipping fees.

Please note parasites, kennel cough, and simple viral infections cannot be included in the health guarantee. Although your puppy will be wormed and vaccinated for kennel cough, it is common for puppies to contract these through the stress of traveling as well as exposure to a new environment.

24-Month Health Guarantee Coverage:

Your puppy will come with a health guarantee for severe hip dysplasia, severe elbow dysplasia, any crippling genetic defects, and any kind of severe cardiac condition for 24 months. Problems must be evaluated and certified by the orthopedic foundation for animals (OFA). There must be no question and be in writing by your veterinarian, that it was not caused by bad nutrition, over feeding, rough play, accident, over exercising, or recklessness. The issue must be documented and brought to our attention prior to 24 months of age.

We don't anticipate encountering many health issues related to hip/elbow dysplasia or any other genetic health disorder, however, we can't guarantee it won't ever happen.

Your health guarantee will be nulled for the following reasons:

  • Malnutrition of dog.
  • Found to be bred without breeding rights.
  • Recklessness including using for dog fighting - A civil fine and repossession will be pursued if it is found that a Peterbuilt dog has been used in dog fighting or in baiting.
  • Must have at least one routine vet visit recorded per year.
  • The health guarantee IS NOT transferrable if the dog is rehomed without our knowledge.

Your puppy selection is not guaranteed until we receive your deposit.

BY SIGNING THIS CONTRACT, YOU ACKNOWLEDGE AND AGREE TO ALL THE TERMS ABOVE.
